1: By placing an order with NimTree Consulting UK, you confirm that you are in agreement with and are bound by the terms and conditions below. An 'order' is deemed to be confirmed after payment has been made. These terms are effectual from the point payment is received from a client whether in full or in part and are governed under Scottish law.
2: NimTree Consulting UK will carry out work only where an agreement is provided either by mail, email or telephone and after payment has been made. NimTree Consulting UK will carry out work only for clients who are 18 years of age or above.
3: NimTree Consulting UK is not affiliated with any search engine network or directory - ALL third party logos or images used on this site remain copyright of their respective companies.
4: NimTree Consulting UK cannot be held responsible for delays or failure of performance resulting from Internet Service Provider delivery problems or failure, including hosting issues where your site is unavailable at any time or any communication or delivery problems associated with Client's receipt of the Account Service data. NimTree Consulting UK shall not be responsible for acts or causes beyond their control, including but not limited to: acts of God, strikes, lockouts, communications line or equipment failures, power failures, earthquakes, or other disasters.
5: NimTree Consulting UK do not warrant or represent that the use or the results of the use of the materials available through NimTree Consulting UK services or from third parties will be correct, accurate, timely, reliable or otherwise.
6: Notwithstanding the security precautions taken against disclosure of information, there are certain conditions that exist on the Internet generally which are outside NimTree Consulting UK control and could result in a breach of security. Accordingly, NimTree Consulting UK cannot guarantee that Your Account Service data information will be free from corruption or piracy. You hereby expressly waive any claim against NimTree Consulting UK arising out of the loss of data through corruption, piracy or breach of security.
7: NimTree Consulting UK cannot be held responsible for URLs dropped or excluded by a search engine for any reason. NimTree Consulting UK do not represent or warrant that Customers' URLs will achieve a favourable position, or any position at all, within a particular search engine as a result of using any of our services. NimTree Consulting UK cannot and DO NOT guarantee indexing (inclusion) or high ranking for any website (submitted by us) on any Search Engine or Directory. Neither can we guarantee that any of our services will increase your website's traffic, page rank (PR) or overall performance on any search engine (at any time). NimTree Consulting UK cannot be held liable or be held responsible for negative fluctuations in any clients search engine positions... customers should be aware that search engine positions and ranking (including page rank) can go down as well as up.
8: You expressly agree that use of the NimTree Consulting UK services provided hereunder is at your sole risk. These Services are provided on an "as is" and "as available" basis. NimTree Consulting UK expressly disclaim all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement.
9: To the maximum extent allowed by law, NimTree Consulting UK and any of their parents, members, subsidiaries, affiliates, service providers, licensors, officers, directors or employees shall not be liable for any direct, indirect, special, incidental or consequential damages (no matter how they arose, including negligence), or for interrupted communications, lost data or lost profits, arising out of or in connection with the services provided hereunder. Further, NimTree Consulting UK will not have any liability for any losses arising because the NimTree Consulting UK services are not operational or accessible. This section does not limit liability for bodily injury of a person.
10: NimTree Consulting UK is not responsible for any adverse affects on search engine ranking or for additional costs incurred if the client has engaged in overwriting SEO work already carried out on the site by NimTree Consulting UK (whether intentionally or accidentally). For example when the client or the client's webmaster has made changes and uploaded or overwritten on-page seo work that has already been provided by NimTree Consulting UK. Neither can NimTree Consulting UK be held responsible when on-page seo work has been overwritten by other parties which may have adversely affected the search engine rankings of the client’s website. Any remedial work required to correct overwritten or adversely affected on-page SEO will be charged to and will be payable by the client.
11: To process your order we require payment for your service in full by Cheque, Online Paypal/Credit/Debit Card Payment or by Bank Transfer. Payment can also be made through our easy payment scheme in monthly installments. NimTree Consulting UK regrets that once any payment has been received NO REFUNDS CAN BE GIVEN.
Complaints Procedure:
Anyone who experiences a problem with the service provided by NimTree Consulting UK should raise the matter with us directly using our online contact form, giving sufficient information and clearly outlining the grounds for complaint.
